By accessing or using AssessmentPro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

AssessmentPro is a cloud-based software platform designed for mold inspection professionals. The Service includes tools for lead management, client communication, inspection documentation, lab report integration, quoting, and business analytics.

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Billing

Some aspects of the Service are provided on a paid subscription basis. You will be billed in advance on a recurring basis ("Billing Cycle"). Billing cycles are set on a monthly or annual basis, depending on the subscription plan you select.

Free Trial

We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

Refunds

Except as required by law, paid subscription fees are non-refundable. If you cancel your subscription, you will continue to have access until the end of your current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal or unauthorized purpose
• Resell or redistribute the Service without authorization
• Collect or harvest user data without consent

6. Your Data

You retain all rights to the data you upload to the Service ("Your Data"). By using the Service, you grant us a limited license to use, store, and process Your Data solely to provide the Service to you.

You are responsible for maintaining backups of Your Data. While we implement robust backup procedures, we are not liable for any loss or corruption of Your Data.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by AssessmentPro and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

8. Third-Party Integrations

The Service may integrate with third-party services (such as payment processors, lab systems, and communication platforms). Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice when possible.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASSESSMENTPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless AssessmentPro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• You may request a copy of Your Data within 30 days
• We may delete Your Data after the 30-day period
• All provisions that should survive termination will remain in effect

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in the United States.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
